Negotiating Divorce

Negotiating DivorceSettling a divorce case outside of the courtroom typically leads to a more positive resolution than taking your divorce case to court. By negotiating your divorce, you can reduce the amount of fighting, avoid appeals, and reduce the cost of your case. This is also a beneficial option, as it allows both you and your spouse to control your fate, rather than having a third party decide it for you.

In cases involving children, reaching a settlement is especially important. Sometimes a divorce trial can get nasty, creating negative feelings between you and your spouse. This negative relationship can affect your children for years following the divorce. In negotiating a divorce, both you and your spouse can work together to end things amicably.

Typically, couples seek a divorce because there are issues in the marriage, such as a lack of communication or trust.  Unfortunately, when the legal process begins, these issues can be exacerbated. It is important to have some level of communication and trust when negotiating the terms of your divorce.

During the negotiation process, it is important to remain cordial to your spouse, even if you are angry. Acting in a positive manner goes a long way in settling your divorce case. It will also keep your case from going to trial because you and your spouse could not agree on the important issues in your divorce.

Disclosing information honestly and voluntarily can also help your divorce negotiation. When one side tries to hide information from the other, it leads to distrust, affecting the settlement process. Handing over all relevant information before being asked builds trust and communication, resulting in a positive settlement.

It is important to keep from getting angry during the negotiation process. Even if you receive a settlement proposal that you believe is outrageous, keeping a cool head will positively affect the outcome in the long run. If you believe a settlement proposal is unreasonable, you can work with your attorney to educate the other side.

Are you going through a divorce? If so, it is important to speak with a lawyer to determine whether negotiating divorce is an option in your case. An experienced divorce lawyer will walk you through each step of the divorce process and ensure you are treated fairly.
